MILANO – Former Prime Minister Silvio Berlusconi was today sentenced by a court in Milan to four years in prison for tax fraud, in the first trial on the alleged irregularities in the sale of TV and film rights by Mediaset .
The chairman of Mediaset Fedele Confalonieri, who was charged with the same charge, was however acquitted for not having committed the crime.
The prosecutor Fabio De Pasquale had requested a sentence of three years and eight months in prison for Berlusconi and 3 years and 4 months for Confalonieri.
At the news, the Mediaset yields up to almost 3%.
The trial, which began in 2006, had as its object the sale of television rights with U.S. companies for 470 million euro to be made by Fininvest – a company owned by the family of former prime minister – through two offshore companies.
For the prosecution, the American majors have sold the rights to two offshore companies, which in turn would then resold them with a strong price increase in Mediaset in order to circumvent the Italian tax authorities and blacks create funds available to Berlusconi . All the accused have denied any wrongdoing.

MILANO – L’ex-presidente del Consiglio Silvio Berlusconi è stato condannato oggi dal tribunale di Milano a quattro anni di carcere per frode fiscale, nell’ambito del processo di primo grado sulle presunte irregolarità nella compravendita di diritti tv e cinematografici da parte di Mediaset.
Il presidente di Mediaset Fedele Confalonieri, imputato con la stessa accusa, è stato invece assolto per non aver commesso il fatto.
Il pm Fabio De Pasquale aveva chiesto una condanna a 3 anni e 8 mesi di reclusione per Berlusconi e a 3 anni e 4 mesi per Confalonieri.
Alla notizia, il titolo Mediaset cede fino a quasi il 3%.
Il processo, iniziato nel 2006, aveva per oggetto la compravendita dei diritti televisivi e cinematografici con società Usa per 470 milioni di euro che sarebbe stata effettuata da Fininvest – società di proprietà della famiglia dell’ex-premier – attraverso due società off-shore.
Per la procura, le major americane avrebbero venduto i diritti alle due società off-shore, le quali a loro volta li avrebbero poi rivenduti con una forte maggiorazione di prezzo a Mediaset allo scopo di aggirare il fisco italiano e creare fondi neri a disposizione di Berlusconi. Tutti gli imputati hanno sempre negato ogni addebito.
